What Are Alteration Agreements?
An alteration agreement is a document intended to protect the building’s infrastructure and make sure that construction in one apartment won’t affect other residents. It typically prohibits activities that could affect building-wide services, structures and utilities. The actual restrictions vary between buildings. You will be expected to sign it before construction begins, and you may be asked to submit renovation plans for approval.
Your alteration agreement should have a list of restrictions, all of which should be discussed with your residential window replacement and renovation contractor. The following are some of the most common restrictions:
Wet Over Dry — The phrase “wet over dry” refers to renovations made in bathrooms or kitchens—that is, “wet” areas—so that they extend over the “dry” areas of your downstairs neighbor: their bedroom, living or dining areas.
Insurance — While general liability insurance is a common part of every renovation contractor’s insurance coverage, apartment renovations may require coverage for at least $1 million. You have to make sure that your contractor’s insurance coverage will meet that of your landlord’s. Workers’ compensation may also be required.
Project Timeline — Alteration agreements may dictate the project timeline, including the days and hours your contractors are allowed to work in your apartment. Projects that go longer than what was scheduled may face a fine—this should be clearly indicated in the agreement.
Review the Alteration Agreement Before Signing it
Whatever the terms your alteration agreement will ultimately have, you need to make sure that everyone is on the same page: you, the building owner and your contractor.
